Conditions to Be Recognized as a Student<\/strong><\/p>\n\n\n\n

    \n
  • Aged between 15 and 27 years<\/strong><\/li>\n\n\n\n
  • Enrolled in an educational institution<\/strong> (in Luxembourg or abroad)<\/li>\n\n\n\n
  • Following a full-time educational program<\/strong>, or having left school less than 4 months ago<\/strong><\/li>\n<\/ul>\n\n\n\n

    Types of Contracts for Summer Work<\/strong><\/p>\n\n\n\n

      \n
    • Student employment contract<\/strong>: concluded between an employer and a student; available in both private and public sectors<\/strong><\/li>\n\n\n\n
    • Temporary employment contract<\/strong> (interim contract)<\/li>\n<\/ul>\n\n\n\n

      Working Duration and Hours<\/strong>
      Students can work a summer or holiday job for up to two months per calendar year<\/strong> (or 346 hours<\/strong> total).<\/p>\n\n\n\n

      The standard working time is 40 hours per week<\/strong>, but it can be adjusted as follows:<\/p>\n\n\n\n

        \n
      • 40 hours\/week<\/strong> for a 2-month contract<\/strong><\/li>\n\n\n\n
      • 28 hours\/week<\/strong> for a 3-month contract<\/strong><\/li>\n\n\n\n
      • 20 hours\/week<\/strong> for a 4-month contract<\/strong><\/li>\n<\/ul>\n\n\n\n

        Rest Periods<\/strong>
        Students are entitled to 44 consecutive hours of rest<\/strong>.<\/p>\n\n\n\n

        Leave<\/strong><\/p>\n\n\n\n

          \n
        • No paid annual leave<\/strong> (26 days per year)<\/li>\n\n\n\n
        • Unpaid exceptional leave<\/strong> may be granted at the employer\u2019s discretion<\/li>\n<\/ul>\n\n\n\n

          Pay<\/strong><\/p>\n\n\n\n

            \n
          • Minimum wage is at least 80% of the applicable minimum wage<\/strong><\/li>\n\n\n\n
          • If a collective agreement<\/strong> exists, it takes precedence<\/li>\n<\/ul>\n<\/div><\/div>\n\n\n\n

            Social Security<\/strong><\/p><\/path><\/svg><\/div>

            \n

            Declaration<\/strong>
            The employer must register the student with the Joint Social Security Centre (Centre Commun de la S\u00e9curit\u00e9 Sociale – CCSS)<\/strong>.<\/p>\n\n\n\n

            Contributions<\/strong>
            No contributions are required for health insurance<\/strong> or old-age pension<\/strong>.<\/p>\n\n\n\n

            Affiliation<\/strong>
            The student is only affiliated for accident insurance<\/strong>, which is paid by the employer<\/strong>.<\/p>\n<\/div><\/div>\n\n\n\n

            Taxes<\/strong><\/p><\/path><\/svg><\/div>

            \n

            At the employer\u2019s request, the Direct Tax Administration (Administration des Contributions Directes – ACD)<\/strong> can grant an exemption from income tax withholding<\/strong> for students employed during school holidays, as long as the hourly wage does not exceed \u20ac16<\/strong>.
            In this case, the student is not required to submit a tax card<\/strong> to the employer.<\/p>\n<\/div><\/div>\n\n\n\n
