Sie d\u00fcrfen maximal 60 % einer Vollzeitstelle arbeiten (das entspricht 964 Stunden pro Jahr), au\u00dfer in bestimmten Sonderf\u00e4llen (z.\u202fB. algerische Studierende oder duale Studieng\u00e4nge mit Ausbildungscharakter).<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><strong><strong>Studierende aus der Europ\u00e4ischen Union<\/strong><\/strong><\/h2>\n\n\n\n<div class=\"wp-block-eures-plugin-accordion-block\"><div class=\"accordion-top\"><p class=\"accordion-title\">Arbeitsrecht<\/p><svg viewBox=\"0 0 24 24\" stroke-width=\"1.5\" fill=\"none\" xmlns=\"http:\/\/www.w3.org\/2000\/svg\" class=\"accordion-top__icon\"><path d=\"M3 12L21 12M21 12L12.5 3.5M21 12L12.5 20.5\" stroke-width=\"1.5\" stroke-linecap=\"round\" stroke-linejoin=\"round\"><\/path><\/svg><\/div><div class=\"accordion-content\">\n<p><strong>Mindestalter<\/strong><\/p>\n\n\n\n<p>Ab 14 Jahren d\u00fcrfen Jugendliche w\u00e4hrend der Schulferien leichte, altersgerechte Arbeiten aus\u00fcben.<br>Bedingungen f\u00fcr 14- bis 16-J\u00e4hrige: Eine Besch\u00e4ftigung ist nur w\u00e4hrend mindestens 14-t\u00e4giger Ferien erlaubt, wobei mindestens die H\u00e4lfte dieser Zeit ununterbrochen frei bleiben muss (z.\u202fB. 7 Tage bei 15-t\u00e4gigen Ferien).<br><br><\/p>\n\n\n\n<p><strong>Arbeitsvertrag<\/strong><\/p>\n\n\n\n<p>In Frankreich gibt es keinen speziellen \u201eStudentenvertrag\u201c. Dennoch k\u00f6nnen klassische Arbeitsvertr\u00e4ge an die Bed\u00fcrfnisse Studierender angepasst werden, z.\u202fB. befristeter Vertrag (CDD), saisonaler CDD, unbefristeter Studentenvertrag (CDI \u00e9tudiant) usw.<br>Besondere Verpflichtung f\u00fcr 14- bis 16-J\u00e4hrige: Der Arbeitgeber muss sp\u00e4testens 15 Tage vor Beginn der Anstellung eine Genehmigung bei der Arbeitsaufsicht beantragen.<br>Zudem muss ein minderj\u00e4hriger, nicht emanzipierter Jugendlicher die Zustimmung seines gesetzlichen Vertreters zur Unterzeichnung eines Arbeitsvertrags einholen.<br>Trotz ihres Status haben Studierende die gleichen Rechte und Pflichten wie andere Arbeitnehmer.<br><br><\/p>\n\n\n\n<p><strong>Arbeitszeit<\/strong><\/p>\n\n\n\n<p>Studierende k\u00f6nnen in Vollzeit oder Teilzeit arbeiten:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li><strong>Vollzeit<\/strong>: 35 Stunden pro Woche<\/li>\n\n\n\n<li><strong>Teilzeit<\/strong>: Die Arbeitszeit kann flexibel verhandelt werden \u2013 \u00fcblich sind 10, 15 oder 20 Stunden pro Woche.<br><br><\/li>\n<\/ul>\n\n\n\n<p><strong>Mindestlohn<\/strong><\/p>\n\n\n\n<p>F\u00fcr Jugendliche unter 18 Jahren gilt:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Mindestens der gesetzliche Mindestlohn (SMIC): Brutto-Stundenlohn 11,88\u202f\u20ac bzw. 1.801,80\u202f\u20ac brutto monatlich<\/li>\n\n\n\n<li>Abz\u00fcge:\n<ul class=\"wp-block-list\">\n<li>20\u202f% Abzug vor dem 17. Geburtstag<\/li>\n\n\n\n<li>10\u202f% Abzug zwischen 17 und 18 Jahren<\/li>\n<\/ul>\n<\/li>\n\n\n\n<li>Ab 18 Jahren besteht Anspruch auf den vollen SMIC.<\/li>\n\n\n\n<li>Wenn ein Tarifvertrag existiert, hat dieser Vorrang.<br><br><\/li>\n<\/ul>\n\n\n\n<p><strong>Urlaub \/ Ruhezeiten<\/strong><\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li><strong>W\u00f6chentliche Ruhezeit<\/strong>: Mindestens 24 aufeinanderfolgende Stunden (Ausnahmen in bestimmten Branchen wie Hotelgewerbe, Gastronomie, Gesundheitswesen)<\/li>\n\n\n\n<li><strong>Urlaub<\/strong>: 2,5 Urlaubstage pro gearbeiteten Monat<\/li>\n\n\n\n<li><strong>Urlaubsentsch\u00e4digung<\/strong>: 10\u202f% des w\u00e4hrend des Vertrags verdienten Bruttogehalts<\/li>\n\n\n\n<li><strong>Vertragsende<\/strong>: Keine Zahlung der sogenannten \u201ePr\u00e9carit\u00e9-Zulage\u201c, wenn der Vertrag w\u00e4hrend der Schul- oder Semesterferien abgeschlossen wurde (Artikel L.1243-10 des franz\u00f6sischen Arbeitsgesetzbuches).<\/li>\n<\/ul>\n<\/div><\/div>\n\n\n\n<div class=\"wp-block-eures-plugin-accordion-block\"><div class=\"accordion-top\"><p class=\"accordion-title\">Sozialversicherung<\/p><svg viewBox=\"0 0 24 24\" stroke-width=\"1.5\" fill=\"none\" xmlns=\"http:\/\/www.w3.org\/2000\/svg\" class=\"accordion-top__icon\"><path d=\"M3 12L21 12M21 12L12.5 3.5M21 12L12.5 20.5\" stroke-width=\"1.5\" stroke-linecap=\"round\" stroke-linejoin=\"round\"><\/path><\/svg><\/div><div class=\"accordion-content\">\n<p>Der Arbeitgeber ist verpflichtet, Sozialversicherungsbeitr\u00e4ge wie bei jedem anderen Arbeitnehmer zu entrichten.<\/p>\n<\/div><\/div>\n\n\n\n<div class=\"wp-block-eures-plugin-accordion-block\"><div class=\"accordion-top\"><p class=\"accordion-title\">Steuerrecht<\/p><svg viewBox=\"0 0 24 24\" stroke-width=\"1.5\" fill=\"none\" xmlns=\"http:\/\/www.w3.org\/2000\/svg\" class=\"accordion-top__icon\"><path d=\"M3 12L21 12M21 12L12.5 3.5M21 12L12.5 20.5\" stroke-width=\"1.5\" stroke-linecap=\"round\" stroke-linejoin=\"round\"><\/path><\/svg><\/div><div class=\"accordion-content\">\n<p><strong>Grundsatz<\/strong><\/p>\n\n\n\n<p>Das Einkommen von Jugendlichen aus Ferien- oder Semesterjobs unterliegt der Einkommenssteuer gem\u00e4\u00df den allgemeinen Regelungen f\u00fcr Geh\u00e4lter.<br>Ab dem 18. Lebensjahr kann ein Studierender eine eigene Steuererkl\u00e4rung abgeben.<br>Bis zum Alter von 25 Jahren kann er jedoch auch im Steuerhaushalt der Eltern bleiben \u2013 in diesem Fall m\u00fcssen die Eink\u00fcnfte in deren Steuererkl\u00e4rung angegeben werden.<br><br><\/p>\n\n\n\n<p><strong>Steuerbefreiung<\/strong><\/p>\n\n\n\n<p>Studierende unter 25 Jahren am 1. Januar des Steuerjahres k\u00f6nnen unter bestimmten Bedingungen von der Einkommensteuer befreit werden \u2013 bis zur H\u00f6he des Dreifachen des monatlichen SMIC. Voraussetzung ist, dass sie sich in schulischer oder universit\u00e4rer Ausbildung befinden.<br>Der Freibetrag basiert auf einer 35-Stunden-Woche und wird angepasst, falls sich der SMIC im Laufe des Jahres \u00e4ndert.<br>Die Steuerbefreiung gilt automatisch, wenn das Einkommen unterhalb des Freibetrags liegt und nicht angegeben wird.<\/p>\n\n\n\n<p>Diese Regelung gilt nicht f\u00fcr Beamtenanw\u00e4rter in Ausbildung (z.\u202fB.
